Terms & Conditions
All sales made by JJ Bakes are subject to the following terms and conditions. Nothing contained within these terms and conditions affects your statutory rights as a consumer. Please read the following terms and conditions: If there is anything you don’t understand please don’t hesitate to contact me. The payment of your deposit or online payment, is an acceptance of these terms and conditions.
In these terms and conditions: "we" means JJ Bakes; and "you" means our customer or prospective customer, and "us", "our" and "your" should be construed accordingly.
The price for bespoke orders shall be agreed before the order is placed. You agree to pay the full price to JJ Bakes no less than 14 days prior to collection/delivery. No items will be handed over without payment in full.
All bespoke orders require a booking fee of 20% of the total cost. Please note that all booking fees are non-refundable and non-transferrable. All booking fees become due when the order has been placed and details checked and agreed by you. All orders are deemed to have been accepted only when the booking fee has been paid.
Payment can be made by PayPal/Bank Transfer/Cash. PayPal/ Bank payments are not received until they are cleared into the bank account of JJ Bakes.
In the event that any payment is withheld or declined, the order will not be completed. Completion of the order will be subject to availability and cannot be guaranteed. The customer may incur additional charges due to late notice.
On delivery or collection, the order will be a true representation of the order description, be of satisfactory quality and comply with all food safety, statutory and regulatory requirements in the UK. We will not be held responsible, nor face no consequent liability, for customer disappointment of the design if the order description is met. We cannot guarantee exact replicas, colour matches, nor will we infringe copy-write products. JJ Bakes takes no responsibility for damage from wilful damage, accident or negligence by you or any third party. Once the product has been delivered, we are unable to accept liability for any damage sustained to the product thereafter nor any failure to follow the instructions provided. The order is a fresh product containing no additives or preservatives and it is our right to assume consumption on the day requested. Storage instructions will be included with all orders. We strongly advise you read and follow these.
Online Postal Orders
The advertising of our products constitutes an "invitation to treat" rather than a contractual offer. No contract will come into force between you and us unless, and until, we accept your order and full payment is made. We do not undertake to continue to supply any particular product, or type of product and we may periodically change the products available for purchase. All online orders are subject to a delivery charge, payable by you, prior to acceptance of the order. Products you purchase will be delivered to the delivery address you specify during the checkout process. We will use reasonable endeavours to deliver your products on or before the date for delivery set out in the order confirmation. We cannot guarantee delivery dates unless the appropriate postage option is purchased. However, as standard, orders will be sent out 1st class on the given date at the point of ordering. We only deliver products to addresses on the UK mainland.
It is your responsibility to advise JJ Bakes of any alterations that may be required to the original order. Any alterations should be requested 14 days prior to collection or delivery date. Late changes (<14 days) cannot always be guaranteed. JJ Bakes reserves the right to increase any quoted fees when variations are required. In this event or JJ Bakes being unable to source certain materials, we reserve the right to replace these with components of equal or better quality. In all cases we will try to contact you to advise you of any such changes.
Your order may be collected at a pre-arranged time. A signature is required upon collection confirming that you have received your order in good condition and as specified. Once the collection time is confirmed a 15-minute grace period shall be allowed and after that point we cannot guarantee a collection time for the same day. If you need to change your collection time for any reason this can be discussed in advance, and if possible accommodated.
Transportation of Cakes
Please ensure that all cakes are transported flat in the boot of a car, preferably on a non-slip mat, with heating off. Cakes should never be held by passengers or placed on the passenger seat. If the cake is not transported flat, then it is the Customer’s responsibility if any damage is caused to the cake. Please also drive sensibly when transporting a cake and avoid speed bumps where possible.
Delivery, not including postal services, will be made at a pre-arranged time. If you require a specific delivery date and require delivery before a given time, please specify this when placing your order. We will do our best to accommodate your requirements, subject to availability. It is your responsibility to ensure that you have given us the correct delivery information, and that someone is available to receive your order. A signature will be required for the receipt of the order upon delivery. If the order is unable to be delivered, the order will be returned to JJ Bakes, who will contact you to arrange an alternative delivery time, for which an additional charge will be payable by you.
As your booking is reserved solely for you, the booking fee will be retained by us in the event of cancellation. In unavoidable circumstances a postponement may be agreed upon but this is entirely at our discretion. If JJ Bakes is unable to complete the order due to unforeseen circumstances the booking fee will be returned.
Due to the nature of products we sell, returns will not be accepted once bespoke delivery or collection has occurred. Due to Distance Selling Contracts, you may withdraw an offer to enter into a contract or cancel a contract with us without giving any reason for your withdrawal or cancellation. This can be requested upon submission of your offer, up to and including the 14th day on which the products are in your/trusted third party physical possession. You must inform us of your decision to withdraw or cancel by means of any clear statement setting out the decision prior to the expiry of the cancellation period. Products must be returned to 3 Kiddens, Hockenden Lane, BR8 7QG no later than 24 days after the day on which you inform us of your decision to cancel the contract. You must pay the direct cost of returning the products. You will receive a full refund including the costs of delivery, unless, chosen delivery costs more than the least expensive delivery we offer. We reserve the right to retain the difference in cost between the kind of delivery you chose and the least expensive kind of delivery that we offer. If the value of the products returned by you is diminished by any amount as a result of the handling of those products by you, beyond what is necessary to establish the nature, characteristics and functioning of the products, we may recover that amount from you up to the contract price. We may recover that amount by deducting it from any refund due to you or require you to pay that amount direct to us. Refunds will be processed within 14 days after the day on which we receive the returned products. If products have not been dispatched at the point of cancellation, a refund will be processed without undue delay, within 14 days after the day on which we were informed of withdrawal. Refunds will be processed using the same method used to make the payment. You will not have any right to cancel a contract if it includes the supply of any sealed perishable food items that have been unsealed and partially or fully consumed by you.
In the case of damaged goods please notify us immediately. You must retain the product and all packaging for inspection by us. Once the alleged damage has been assessed in line with our Terms & Conditions we will either refund the damaged goods in full, including postage costs or may, if indicated, provide a credit for further orders.
Whilst every effort is made to display our products as accurately as possible, the colours of our products that appear online will depend entirely on your monitor, screen settings and resolution. We cannot guarantee that your monitor will accurately reflect the colour of the product on collection or delivery. The images of our products are for illustrative purposes only and your product may vary slightly from these images. We reserve the right to use any image of a Customer’s item made by the Company for publication after the delivery date. You have no ownership rights over any design.
Our products are made in an environment where nuts, eggs, milk, gluten and other allergens are present. Please be aware that whilst your chosen items may be made without a specified allergen, it will be prepared in a kitchen where all 14 allergens may be used in other products. Therefore, JJ Bakes is unable to guarantee an allergen free cake.
All orders will include a list of any/all non-edibles, including quantities if indicated. This includes, but is not limited to, internal inedible support and external non-edible decoration. These should always be removed before serving.
